DISPUTES RESOLVED IN COURT
AND BY ARBITRATION
We represent our clients in judicial and arbitration proceedings, in the areas of civil law, intellectual property, Internet domains, etc. We have been and continue to be engaged in disputes connected with non-performance or inadequate performance of licence, implementation and support agreements, including international trials. We have experience in proceedings conducted by courts of law and in arbitration with the Polish Chamber of Commerce and the ICC. In some of the more extensive proceedings, we work together with international law firms, where our role is that of an expert on IT or telecommunication issues.
The range of our services covers both preparatory activities (audits and opinions — in a number of cases they indicate that litigation would be too costly and risky), drafting the lawsuit and other pleadings, verification of evidence, cooperation with individuals responsible for the project during the proceedings, participation in hearings and sessions. We also actively support negotiations leading to out-of-court settlement.
In addition to civil trials, we have experience in administrative and fiscal disputes relating to the broadly-defined IT industry — from antitrust issues to proceedings conducted by tax authorities and administrative courts (VAT on licences, withholding tax, classification of IT expenditures: CAPEX/OPEX).
